Terms of Service

RAPID SMTP is a hosted dashboard that lets you connect your own SMTP credentials, manage contacts, build templates, and dispatch transactional or bulk email. We provide the application, the scheduler, the delivery logs, and a web UI. We do not provide the underlying SMTP relay — that is owned by you or your third-party provider.

• You must be at least 16 years old to use the service.
• You are responsible for the accuracy of the information you provide, including the business or organisation an account represents.
• You are responsible for safeguarding your login credentials and for everything done under your account. Notify us immediately at company@rapidhostbd.com if you suspect unauthorised access.
• One person should not share a single account; create separate users instead.

You agree not to use RAPID SMTP, directly or indirectly, to send:

• Unsolicited bulk email (spam) or email to addresses obtained without consent, scraped or purchased.
• Phishing, fraud, impersonation, or any message designed to deceive recipients about its origin.
• Malware, ransomware, or links pointing to such content.
• Content that infringes intellectual-property, publicity or privacy rights of others.
• Content that promotes violence, terrorism, child exploitation, or any unlawful activity under Bangladesh law or the laws applicable to the recipient.
• Content that violates the acceptable-use policy of the SMTP provider you have configured.

Every commercial email you send must include a working unsubscribe link and an accurate sender identity. We reserve the right to throttle, suspend, or terminate accounts that breach this section, with or without notice depending on severity.

• You bring your own SMTP credentials. Sending limits, IP reputation, deliverability and provider terms are between you and that provider.
• We are not liable for messages refused, throttled, blacklisted, or bounced by your SMTP provider, recipient mail server, or downstream blocklists.
• You must configure SPF, DKIM and DMARC on the sending domain. The platform shows DNS hints but does not change records on your behalf.

• The Free plan is offered as-is and may be rate-limited, paused or changed at our discretion.
• Paid plans renew automatically every billing period unless cancelled before the renewal date.
• Prices are displayed in BDT and exclude any applicable tax, which we will add at checkout where required.
• Cancellations take effect at the end of the current billing period; the account stays active until then.
• Because the service is digital and consumed immediately, paid periods are non-refundable except where required by law. We may, at our discretion, credit a future invoice for verified service outages.
• Failure to pay an invoice may result in suspension after a 7-day grace period and deletion of the workspace 30 days later.

• You retain ownership of all contacts, templates and email content you upload.
• You grant us a limited licence to host, process and transmit that content solely to operate the service.
• We treat your data as confidential, restrict internal access, and only disclose it where strictly necessary for support or required by law.
• Our processing of personal data is described in the Privacy Policy, which is part of these Terms.

We work to keep the platform highly available but do not guarantee uninterrupted service. Planned maintenance is announced in advance where possible. Emergency maintenance may occur without notice. There is no monetary service-level credit on Free or standard paid plans; bespoke SLAs are available on Business and Enterprise contracts.

• You may delete your account at any time from the dashboard.
• We may suspend or terminate an account that (a) breaches these Terms, (b) presents a security or abuse risk, (c) is the subject of a credible legal complaint, or (d) has not paid an outstanding invoice after 7 days.
• On termination, the workspace is queued for deletion and removed within 30 days, except where law requires longer retention (e.g. billing records).

The RAPID SMTP brand, dashboard, source code, documentation, and marketing copy are owned by RapidHost BD. You may not reverse-engineer the product, copy the user interface, or use our trademarks without prior written permission.

The service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that email you send will reach the inbox of every recipient.

To the maximum extent permitted by law, our aggregate liability under these Terms is limited to the fees you actually paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special or punitive damages, lost profits, lost revenue, loss of reputation, or lost data, even if advised of the possibility.

You will defend and hold us harmless against any third-party claim arising from (a) your email content, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

These Terms are governed by the laws of Bangladesh. The courts of Dhaka have exclusive jurisdiction, except that we may bring proceedings to protect our intellectual property in any jurisdiction.

We may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance.
